ANVIL’s Information Collection, Use, and Sharing Approach

Further, the offline manner in which any user data is stored is done in a secure environment that only ANVIL’s owners can access; any sharing of said information with necessary employees or sub-contractors is always initiated by ANVIL’s owners personally.

ANVIL Reserves the Right to Change this Privacy Policy

ANVIL is the sole owner of www.createwithanvil.com and www.anvilideation.com. As such, we reserve the right to make changes to this privacy policy at our sole discretion. These revisions may be initiated by changes in the law, to ANVIL policies, changes to our sites, other factors, or no reason at all. For ANVIL Users Visiting Our Sites from Outside the United States

ANVIL is a virtual entity, able to provide services and support to anyone in the world, but we are headquartered in the United States (U.S.). User information, including personal information that is provided by users like you, may need to be transferred, stored at and processed by us and other 3rd-party organizations outside the country in which you reside, including but not limited to the U.S. While the data protection and privacy regulations in your location may not be the same as the U.S., ANVIL seeks to offer the same level of protection of user data that would be afforded to any user where they are at; We make reasonable efforts to ensure that user data is treated securely in all situations and in accordance with the privacy policy here.

Any references ANVIL makes to “personal information” or “user data” in this policy can be considered equal to “personal data” in relation to the European Union (E.U.) data protection legislation. We implement the following safeguards if and when user data originating from users in the E.U. is transferred to other countries:

ANVIL Abides by the E.U.-U.S. Privacy Shield

ANVIL Ideation, LLC, follows the E.U.-U.S. Privacy Shield Framework, from the U.S. Department of Commerce, when it comes to collecting, using, and retaining user data provided to us from users in the E.U.

ANVIL takes responsibility for processing user data received under the Privacy Shield Framework, as well as any subsequent transfers of that data to 3rd-party organizations, acting as agents on our behalf. We further seek to meet the Privacy Shield Principles for transfers of user data from the E.U., including the onward transfer of any liability provisions. We are subject to the regulatory enforcement powers of the U.S. Federal Trade Commission as part of this, and as such we agree to cooperate with the E.U. data protection authorities and follow with direction or advice they provide us, in regards to any user data we transfer from the E.U. as part of an employment relationship. There are unique situations where ANVIL may need to user data in response to lawful requests by public authorities (i.e., in order to abide by national security or law enforcement requirements).

ANVIL will resolve any complaints any user has about our collection or use of user data as part of abiding by the Privacy Shield Principles. Users from the E.U. with questions, concerns, or complaints regarding our Privacy Shield policy should refer to the Contact Us section above.

ANVIL’s Legal Bases for Processing User Data

ANVIL Ideation, LLC, only uses user data as permitted by law. We will inform users, through this policy, of the legal bases around how we process user data. These are noted below:

  • So ANVIL can provide services and support: We have to process user data in order to perform any contractual or agreed-upon duties;
  • So ANVIL can communicate with users;
  • So ANVIL can update or improve the user experience: We need to know about users to improve how we provide services and support, our interests or desires to use data are always weighed against the impact to users, even going so far as to ask for user consent, whether it is required by law or not;
  • So ANVIL can maintain compliance, fraud prevention and safety measures; and
  • So ANVIL can comply with law.

ANVIL Ideation, LLC allows any user to opt out of anything which they have previously given consent by contacting us. However, depending on work already performed or the nature of the request, there may be limitations regarding when and how that opting out takes place or what the nature of “opting out” looks like.

ANVIL’s Use of Data for New Purposes

ANVIL may use user data in ways that are not presently covered in the scope of this policy. These uses will always be within the uses permitted by law and only with the data that is directly related to the purposes for which we collected it. If user data is utilized this way, we always notify the related users and explain the legal basis and reason for which the data is being used this way.

Your Rights to ANVIL User Data

ANVIL seeks to ensure equality of user data rights to all users of www.createwithanvil.com and www.anvilideation.com. As such, users are afforded the right to the following in relation to their personal user data that we may have:

  • Opting out: We will stop sending any direct marketing communications or non-essential communications to the user. The user still receive necessary communications associated with provided service and support;
  • Data Access: We will provide the user with information about how we are processing and making use of their user data, as well as give the user access to that data, for their review;
  • Data Update: We will provide the user the right to update or correct inaccuracies in their user data.
  • Data Deletion: We will delete the user’s data, but tt should be noted that deletion of data represents the dissolving of any previous or existing relationship between ANVIL Ideation, LLC, and the user, meaning that deletion may not be possible until any existing requirements (i.e., payment for services, resolving contracts) are met;
  • Data Transfer: We will transfer a machine-readable copy of the user data to the user or a 3rd-party organization of the user’s choice;
  • Data Restriction: We will implement a restriction, as requested by the user, to prevent processing of their user data; and
  • Data Objection: We will implement a halt to the use of the user’s data for any use beyond absolutely-necessary actions.

ANVIL may follow up and request further context or information to confirm your identity and to be able to properly provide services and support. We reserve the right – based on applicable law, scope of work, nature of the request, or no reason at all – to decline a request. That said, should we we decline a request, we will provide an explanation (within reason and legal restrictions). If a user wishes to submit a concern or complaint about our use of user data, the Contact Us information above and a submission of a complaint to the a data protection regulator in your area is recommended.

ANVIL’s Cross-Border Data Transfer Approach

ANVIL may, when absolutely necessary, need to transfer user data to locales not deemed by the European Commission or other data protection regulatory bodies to have adequate levels of personal information protection. In these unique cases, the data transfer will be based on one of the following, which are recognized by the European Commission as having adequate protection:

  • Contracts that follow the European Commission’s Model: We ensure that data protection obligations are placed on the 3rd-party organization responsible for the transfer, based on European Commission Model contracts for the transfer of personal information; and
  • Organizations meeting E.U.-U.S. Privacy Shield Framework: We only work with 3rd-party organizations who participate in the E.U.-U.S. Privacy Shield Framework.
